Terms of Service

Effective June 22, 2026

These Terms of Service ("Terms") are a binding agreement between you and Traveled Out, a sole proprietorship ("Traveled Out," "we," "us," or "our"). They govern your use of our website and services (the "Service"). By creating an account, joining our waitlist, or otherwise using the Service, you agree to these Terms. They include an arbitration agreement and class-action waiver (Section 12) that affect how disputes are resolved — please read them.

1. Acceptance of these terms

By accessing or using the Service, you agree to these Terms and to our Privacy Policy. We may update these Terms from time to time; we will post material changes here with a new effective date, and your continued use of the Service means you accept the updated Terms.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for users located in the United States.

3. The service, and its nature

Traveled Out is a premium travel and points-and-miles strategy advisory. We provide information, recommendations, and draft itineraries and strategies to help you plan travel and make use of your own credit-card points, miles, and loyalty benefits. Please understand the following about what we do and do not provide:

  • Advisory and informational only. Our content is general advisory information. It is not legal, visa or immigration, tax, accounting, financial, or medical advice, and it is not a substitute for advice from a qualified professional. Always confirm entry, visa, passport, and travel-document requirements with official government sources before you book or travel.
  • Advisory drafts, not bookings. Itineraries, strategies, and recommendations are starting drafts to be refined with you. They are not reservations, bookings, or guarantees, and we do not book travel, hold inventory, or transact on your behalf.
  • AI-assisted output. Parts of the Service use artificial intelligence to generate recommendations and drafts. AI output may be incomplete, out of date, or incorrect. You are responsible for independently verifying any information before relying on it.
  • No guarantees. Prices, award availability, points valuations, transfer ratios, promotions, approvals, and program rules change frequently and are outside our control. We do not guarantee any particular availability, price, result, approval, or savings.
  • Your decisions are your own. You are solely responsible for your bookings, purchases, applications, and travel decisions, and for meeting all entry, visa, health, and travel-document requirements.

4. Your account and profile data

You access the Service by signing in with Google. You are responsible for safeguarding your account and for activity that occurs under it.

The profile information you provide — your travel preferences, credit-card and points holdings, frequent-flyer and loyalty programs, personal notes, and trip context — is used to personalize and generate your advisory output, and you are responsible for its accuracy. Some of this information (including personal notes and loyalty identifiers) may be processed by our service providers, including AI providers such as Anthropic, to generate advisory drafts; see our Privacy Policy for details. We never collect or store full credit-card numbers, security codes, or expiration dates.

5. Memberships and billing

Traveled Out offers membership tiers (currently Membership at $99 per month, Membership+ at $249 per month, and a one-time session at $299) that differ by the level of access and advisory service they include; see our membership page for current details. Memberships are billed in advance and renew automatically until you cancel, and you may cancel at any time to stop future billing. Except where required by law, fees already paid are non-refundable, including for partial billing periods.

The Service is currently offered by invitation and waitlist; the billing terms above apply when paid subscriptions become available. We may change pricing or tier features on a going-forward basis, with notice.

6. Acceptable use

You agree to use the Service only for your own lawful, personal travel planning. You will not: access the Service in unauthorized ways; reverse-engineer, scrape, or bulk-extract its content or outputs; interfere with its operation or security; infringe the rights of others; submit unlawful or harmful content; or use the Service or its outputs to build, train, or operate a competing product or service.

7. Intellectual property

The Service — including our content, software, methods, and brand — is owned by Traveled Out and protected by applicable law. We grant you a limited, personal, non-transferable, revocable license to use the Service and the advisory output we provide for your own travel planning. You retain ownership of the information you submit, and you grant us a license to use it to operate, provide, secure, and improve the Service.

8. Third-party services

The Service relies on and may link to third-party services (for example, Google sign-in, and — as features launch — scheduling and payment providers). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY INFORMATION — INCLUDING AI-GENERATED OUTPUT — IS ACCURATE, COMPLETE, OR CURRENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAVELED OUT AND ITS OWNER, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Traveled Out and its owner, employees, and agents from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from or relating to your use of the Service, the information you submit, your travel decisions, or your violation of these Terms or applicable law.

12. Dispute resolution; arbitration and class-action waiver

Please read this section carefully — it affects your legal rights. You and Traveled Out agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration, rather than in court, before a recognized arbitration provider under its consumer arbitration rules, seated in Texas.

YOU AND TRAVELED OUT WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION. Either party may still bring an individual claim in small-claims court if it qualifies. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing admiral@traveledout.com.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any matter not subject to arbitration will be brought exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction.

13. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or to protect the Service or others. You may stop using the Service at any time. Provisions that by their nature should survive termination — including the disclaimers, limitation of liability, indemnification, and dispute-resolution sections — will survive.

14. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, financing, or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and Traveled Out regarding the Service.
